Advanced IP Workshop—Overview of U.S. Trademark Oppositions and Recent Case Studies on U.S. Patent Law

Finnegan’s Shanghai Office cordially invites you to attend the next event of its exclusive Advanced Intellectual Property Seminar Program series. This program features Finnegan attorneys B. Brett Heavner and Qingyu Yin discussing recent developments on U.S. trademark and patent law.

Historically, U.S. trademark oppositions and cancellations were not hotly litigated because the only issue decided was whether the trademark registration should issue. The Trademark Trial and Appeal Board (TTAB) did not decide the ability to use the mark or award monetary damages. If there was subsequent trademark infringement litigation, the parties always assumed that the federal court was free to reach a different result than the TTAB. In 2015, however, the U.S. Supreme Court held that if the TTAB rules first on a substantive issue (such as likelihood of confusion or abandonment), that decision may be binding in the later infringement action. B&B Hardware, Inc. v. Hargis Industries, Inc. Consequently, oppositions and cancellations before the TTAB must now be taken far more seriously. Failure to devote sufficient resources and vigor to a TTAB proceeding could lead to an unfavorable result, which in turn could bind the court hearing a subsequent infringement action.

In this workshop, we will also discuss the most recent cases on U.S. patent law and case studies on IP issues in cross-border e-commerce activities.
