The Finnegan team filed a motion to dismiss challenging both the sufficiency of VDPP's infringement allegations under Rule 12(b)(6) and venue under Rule 12(b)(3). Faced with the pending motion and after attempting to cure deficiencies through two amended complaints, VDPP voluntarily dismissed all claims against Axis.
