Victor Palace focuses on patent litigation in U.S. district courts and at the International Trade Commission (ITC), where he represents clients' various technologies, including computer software, artificial intelligence (AI) / machine learning (ML), consumer electronics, and mechanical devices. He has a technical background in electrical and computer engineering and experience in a wide range of industries, such as consumer products, e-commerce, and telecommunications.
Victor is well-versed in aspects of patent litigation. His experience includes developing infringement and invalidity positions, managing discovery, taking and defending depositions, working with experts, and trial strategy. Victor's technical background in computer programming enables him to effectively conduct source code analysis and work closely with expert witnesses in software-related patent disputes.
In addition to his litigation practice, Victor advises clients on a wide range of patent matters, including patent procurement and portfolio management. He has experience in drafting and prosecuting patent applications in various technical fields, such as AI, communications platforms, and medical software.
Victor dedicates a portion of time and effort to pro bono work and diversity efforts. He works with military veterans, asylum immigration matters, and landlord/tenant disputes. For his commitment, Victor has been recognized on the Capital Pro Bono Honor Roll.
VDPP, LLC v. Axis Communications, Inc.
Successfully defended Axis Communications in a patent infringement lawsuit brought by VDPP, LLC in the Eastern District of Texas involving video processing technology. The Finnegan team filed a motion to dismiss challenging both the sufficiency of VDPP's infringement allegations under Rule 12(b)(6) and venue under Rule 12(b)(3). Faced with the pending motion and after attempting to cure deficiencies through two amended complaints, VDPP voluntarily dismissed all claims against Axis.
