Sonja Sahlsten focuses on patent and trade secret litigation in U.S. district courts and appeals to the U.S. Court of Appeals for the Federal Circuit, where she served as a law clerk. She has a technical background in mechanical engineering, with experience across an array of technologies including those related to medical devices, industrial manufacturing, amusement parks, sports, fitness, and outdoor recreation, and biotechnology. Sonja is board certified in intellectual property by The Florida Bar.

Sonja is experienced in all phases of patent litigation in district courts, from complaint to trial and post-trial. Her experience includes formulating infringement, validity, and claim construction positions; managing discovery and arguing discovery motions; taking and defending fact and expert depositions; preparing witnesses for deposition and trial; examining and cross-examining fact and expert witnesses at trial; and drafting claim construction, summary judgment, and pre- and post-trial motions and briefs. Sonja has also successfully represented parties in post-grant proceedings such as inter partes review (IPR) and ex parte reexamination. Her experience with trade secrets includes both litigation and counseling.

Sonja’s patent prosecution work involves drafting and prosecuting U.S. utility and design patent applications. She has experience with design patents related to consumer products, medical device, and graphical user interfaces (GUIs) and icons. She has prosecuted families of design patents before the U.S. Patent and Trademark Office (USPTO) and helped direct prosecution in foreign countries.

Sonja is passionate about diversity in IP and working with pro bono clients. As one of the partners-in-charge of pro bono at Finnegan, she focuses her pro bono work on post-conviction relief. Clients she has represented include a former inmate who received a reduction of his 35-year-to-life sentence under the Incarceration Reduction Amendment Act (IRAA) and was released, and another whose 40-year-to life sentence was reduced to time served under the Second Look Amendment Act (SLAA) and was released. Sonja is listed on the Capital Pro Bono Honor Roll. She serves as the co-Chair of the Washington, DC, chapter of Women in IP Network (WIN) and is involved in Finnegan FORWARD (Focused on Raising Women’s Advancement, Representation, and Development), the firm’s women’s business initiative.

While in law school, Sonja served as a legal intern to the Honorable Anne C. Conway at the U.S. District Court for the M.D. Florida. She also worked for the University of Florida Office of Technology Licensing, where she performed patent due diligence in a wide range of technologies, including mechanical, structural, and agricultural innovations.

Before law school, Sonja conducted research on the design and optimization of a novel polygeneration system implemented in communities affected by natural disasters. She also conducted research and testing in green building and home automation technology.

Securing intellectual property for electric skateboard company Walnut Technology in its quest to conquer the “last mile” problem
Hong Kong-based Walnut Technology relies on Finnegan to protect its technology, designs, and trademarks in the United States for its SPECTRA Pro Skateboard and backpack transport system. Walnut’s product is equipped with the world’s first 3D posture control system in a skateboard, which self-learns to control the rider’s speed and turning. It can be ridden like a regular skateboard while the regenerative braking charges up the battery. Not only did Walnut raise more than eight times its funding goal on Indiegogo, but its design won a coveted Red Dot design award in 2017. Walnut (and its investors) know that the SPECTRA has comprehensive IP protection wherever it goes.

Maglula, Ltd. v. Amazon.Com, Inc. et al

Trade secret and breach of contract dispute resolved with favorable settlement for Finnegan client Meati Foods

Finnegan represented Emergy, Inc., d/b/a Meati Foods in a trade secret misappropriation, breach of contract, and correction of inventorship case against The Better Meat Company (BMC) and Augustus Pattillo involving alternative meat made from mycelium.

Emergy alleged that Augustus Pattillo stole its trade secrets on the cultivation and production of mycelium that he learned while working as a lab technician for Emergy’s founders, misused them in his work with BMC, breached his nondisclosure agreement with Emergy, and improperly filed patent applications on Emergy’s technology and assigned them to BMC.

BMC filed claims of tortious interference and unfair competition against Emergy, which Emergy succeeded in striking under California’s anti-Strategic Lawsuits Against Public Participation (SLAPP) statute. After prevailing under the anti-SLAPP statute, Emergy was statutorily entitled to recover its reasonable attorneys’ fees and costs for defending against BMC’s stricken claims of tortious interference and unfair competition

Early in the litigation, Emergy defeated BMC’s motion to dismiss Emergy’s trade secret misappropriation and breach of implied contract claims. Emergy later defeated BMC’s motion for summary judgment on Emergy’s trade secret misappropriation, breach of contract, and breach of implied contract claims. The case settled soon after the Court issued its summary judgment ruling.
