When Your Patent Case Goes to Trial: Setting the Record for Appeal

Win, lose, or draw, the decision in your patent case is likely to be appealed to the Court of Appeals for the Federal Circuit. The trial record sets the stage for the appellate case, so it is imperative to develop your trial strategy with the Federal Circuit rules and procedures as well as current trends in close focus.

Please join our panel of Finnegan attorneys, including former Federal Circuit clerks, for an interactive discussion on issues relating to:

  • Trying your case with an eye towards the appeal
  • The Federal Circuit’s broad view of waiver
  • Adequately preserving issues for appeal
  • Anticipating, and preparing for, changes in the law

In their discussion of setting the record, Justin Hendrix, Erik Puknys, and Jacob Schroeder will address the implications of the new claim construction standard recently announced by the Supreme Court. They will also discuss unsettled areas of patent law, provide their predictions, and offer strategies regarding how to adequately preserve your ability to take advantage of any future changes in these areas.
