Prosecution Strategies in View of the Severely Diminished Allowance Rate at the USPTO

One of the causes for the reduced allowance rate is the aftermath of the U.S. Supreme Court’s 2007 decision in KSR v. Teleflex. That case altered the way in which the USPTO evaluates obviousness. Finnegan partner Anthony Tridico  will provide detailed examples of the types of arguments that may be successful in overcoming obviousness rejections in this new environment. And we will discuss application drafting techniques that may improve the chances of success in obtaining allowance.
