With several new rules packages already released in the three years that inter partes review (IPR), post-grant review (PGR), including covered business method patents (CBM) proceedings have been available, practice before the Patent Trial and Appeal Board (PTAB) is evolving quickly. Containing what the U.S. Patent and Trademark Office (USPTO) calls “more involved” changes to the rules for PTAB trials, the latest proposed rules package released on August 19, 2015, may provide new challenges and opportunities for both patent owners and petitioners. If adopted, these rules will constitute the most significant changes to the rules of practice since PTAB trials became available.
