With the enactment of the Defend Trade Secrets Act (DTSA) in 2016, trade secret litigation in federal courts has grown. Yet many companies, including those in the pharmaceutical industry, have not fully realized the potential benefits of supplementing their patent portfolios with trade secrets on certain innovations and surrounding information, processes, research, and techniques.
Once a company identifies the types of information that may benefit from trade secret protection, it can determine how to best protect the information in conjunction with its patented inventions. Companies with trade secrets should proactively protect them, including when making submissions to the USPTO and the FDA.
