Changes in U.S. patent law under the America Invents Act (“AIA”) and the U.S. Patent and Trademark Office’s implementing regulations have created several new opportunities, as well as new risks. Navigating through the new laws and regulations requires careful planning. Companies not only need to evaluate possible strategies to protect their own inventions, but also should consider new avenues to attack competitors’ patents. By understanding the AIA and the regulations, you can better exploit the new opportunities and minimize the risks.
