New Cost-Effective Ways to Kill Your Competitors’ U.S. Patents Without Going To Court

Sued for patent infringement? Facing the possibility of paying hundreds of thousands or maybe millions of dollars to defend the case? Consider instead using one of the latest defense strategies to rip the patent to shreds in the U.S. Patent and Trademark Office! Companies of all sizes are doing this and it’s beginning to pay off. Most important, early reports indicate that the new ways to destroy  patents are significantly cheaper than defending cases in US courts. At first you might think the Patent Office is unlikely to undo the work of its own examiners, but this is exactly what the new patent judges are charged with doing – and they are doing it!  In just over one year, the judges have instituted over 200 trials challenging patents with roughly 450 more petitions to consider. During this lecture we’ll explore the most recent developments in patent litigation. Finnegan partner Jeff Berkowitz will discuss advantages/disadvantages of each new defense strategy and lessons learned from first-hand experience.
