Patent litigation in the United States differs from that in other countries in many respects, especially in the scope of information opposing parties may demand from each other. Finnegan attorneys experienced in biotechnology and pharmaceutical patent litigation will lead attendees through an in-depth look at the discovery process in U.S. courts using practical examples of discovery that might be taken in a hypothetical case, which will be based on materials to be distributed in advance of the session.

Topics to be discussed include:

  • The scope and sequence of discovery in the United States 
  • Upcoming changes in the rules governing discovery in the United States 
  • The types of discovery available 
    • Initial disclosures 
    • Document requests 
    • Interrogatories 
    • Requests for admission

  • How to respond to discovery requests
  • Objecting to discovery requests, including when and how to assert the attorney client privilege.

The presentation will conclude with a mock deposition of the named inventor in the patent issue in the hypothetical case.
