Although not entirely unique, the U.S. litigation system—with its extensive fact and expert discovery—is foreign to many overseas companies who find themselves immersed in U.S. patent litigation, whether or not for the first time. A strategic pre-litigation analysis helps to demystify the process and put patentees and potential infringers alike in a prepared position to face U.S. litigation. Our panelists, with over 40 years combined experience in U.S. district court litigation, will provide insights on the following topics:

  • Diligence: Developing initial theories of the case and collecting key documents and interviewing key witnesses to test those theories
  • Engaging experts early
  • Sorting out attorney-client privilege and work product applicability to documents and correspondence involving non-U.S. patent attorneys and lawyers
  • Venue and jurisdictional considerations
  • The changed landscape in the United States relating to attorneys’ fees
