Comparative advertising refers to any advertising which explicitly or by implication identifies a competitor or their goods or services. There are specific laws on comparative advertising which must be obeyed to avoid complaints. Navigating the legal requirements can be a tricky task especially when the advertisement will be exposed to multiple jurisdictions. A summary of the dos and don’ts of Comparative Advertising in the UK can be found on Finnegan’s European IP Blog here.
