Getting a patent granted is just the first step. Enforcement is the second step. Prosecuting attorneys should continually consider the entity or entities that will ultimately infringe the claims after the patent is granted. For example, will multiple actors work together to perform all the steps of a method claim? Will components be combined by manufacturers or end users? It is important to consider who the targeted infringing entity is or will be throughout prosecution.

Please join our panel as they discuss the statutory origins of direct, indirect, contributory, and induced infringement; the differences between them; recent case law specific to these distinct types of infringement; similarities between the U.S. and the UK; and strategies for obtaining valuable patents ready for enforcement.

Topics will include:

  • Overview of the existing standards for indirect, contributory, and divided infringement in the United States and United Kingdom
  • Update and considerations in view of U.S. and UK case law
  • Practical examples and strategies to increase the likelihood of proving infringement
