The America Invents Act makes profound changes to U.S. patent law, some of which are effective now and others that are implemented over the next 12 or 18 months. Keeping in mind that schedule, we will examine the practical effects of the new law on litigation and prosecution strategies, with emphasis on:
• Immediate Changes: Appeals, Fees, Jurisdiction, Marking, and Prioritized Examination
• One-Year Changes: Post-Grant Review and Supplemental Examination
• 18-Month Changes: Derivation, First-to-file, and New Section 102
Finnegan will apply for 1.5 hours of CLE credit from the State Bar of Georgia.
