Matthew Hlinka has experience across all areas of patent and trade secret law, focusing primarily on litigation in the areas of pharmaceuticals and chemical products. He has successfully represented several branded pharmaceutical companies in Abbreviated New Drug Application (ANDA) litigations arising under the Hatch-Waxman Act in U.S. district courts as well as in international arbitration proceedings, in Section 337 proceedings before the International Trade Commission (ITC), and in post-grant proceedings before the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO).

Matthew’s litigation experience spans all phases of federal district court and ITC litigation as well as international arbitration, from pre-suit investigations through trial and post-trial briefing. His responsibilities include developing and preparing detailed contentions, managing complex discovery, taking and defending fact and expert depositions, working with expert witnesses to prepare expert reports, drafting briefs and motions, and conducting direct and cross examinations of witnesses at trial. Matthew is an experienced manager of litigation teams and day-to-day litigation activities. 

Matthew’s practice includes patent prosecution and client counseling. He handles preparing and prosecuting U.S. patent applications, coordinating foreign prosecution, developing patent portfolio strategies, preparing opinions on patent infringement and validity, and drafting license agreements.

Prior to his legal career, Matthew worked as an instrumentation engineer for Ambitech Engineering in Downers Grove, Illinois. He provided on-site construction field support and assisted with the specification and procurement of instrumentation for a new polysilicate production plant.


Matthew has been repeatedly recognized by the D.C. Bar’s Capital Pro Bono Honor Roll for his advocacy on behalf of disabled veterans before the U.S. Court of Appeals for Veterans Claims.

Trial counsel for Novartis in district court litigation against multiple generics related to KISQALI®, a breakthrough CDK4/6-inhibitor for the treatment of breast cancer.

AstraZeneca AB v. Zydus Pharmaceuticals (USA) Inc.

Trial counsel for AstraZeneca in Abbreviated New Drug Application (ANDA) litigation against Zydus on its blockbuster Farxiga® pharmaceutical drug product. After a bench trial, Judge Andrews ruled that the defendant failed to prove that any of the patent claims at issue were invalid due to obviousness, resulting in a complete win for our client. That decision was not ultimately appealed.

Secured a permanent injunction against generic defendant on behalf of Valeant in Hatch-Waxman patent infringement litigation concerning an ANDA for generic versions of Cardizem® LA.

Valeant Pharmaceuticals Int’l, Inc. v. Mylan Pharmaceuticals, Inc. 

Represented Valeant, Salix, and Progenics in Hatch-Waxman patent infringement litigation concerning multiple ANDAs for generic subcutaneous versions of Relistor®. The District of New Jersey granted summary judgment in favor of Valeant, Salix and Progenics on U.S. Patent No. 8,552,025 covering Subcutaneous Relistor® through 2024.
