The Defend Trade Secrets Act (“DTSA”) recently passed in Congress with widespread support. The DTSA aims to place trade secrets on equal footing with other forms of intellectual property by creating a new federal civil cause of action for trade secret misappropriation. While similar to the long-standing Uniform Trade Secrets Act in many respects, the DTSA includes certain key departures from the Uniform Trade Secrets Act, including an ex parte seizure provision and whistleblower protections. Proponents of the Act hope that it will provide a meaningful mechanism for companies to combat the growing problem of trade secret misappropriation.
