Much has happened since the Supreme Court’s Alice decision in 2014 that fundamentally changed the landscape for computer and software innovations in the United States. While both the Federal Circuit and the USPTO have made efforts to provide guidance to applicants and litigants, there is still much uncertainty when it comes to assessing patent eligibility under 35 U.S.C. § 101. Looking overseas to Europe, many have found the EPO’s decisions and claim approaches—such as the technical problem/solution inquiry—to be helpful in developing global drafting and prosecution strategies. Join our panel as we cover the following topics in this webinar:

  • Recent Federal Circuit decisions impacting patent eligibility in the United States, including Enfish and Bascom
  • The USPTO’s updated examination guidelines and examples for Section 101
  • Strategies for successfully navigating your patent application through the USPTO
  • EPO guidance and recent case law demonstrating what works and what doesn’t
  • Best practices and global strategies in view of these trends/developments, including comparing and contrasting U.S. and European law and practices

This webinar is the fourth in Finnegan’s 2016 “Strategic Patent Series for European Counsel.”
