David Lefcowitz focuses on patent litigation in federal courts and before the U.S. International Trade Commission (ITC).
David leverages his extensive experience as a patent litigator to represent clients in proceedings involving various technologies, including computer software, automotive technologies, and medical devices as well as financial technologies. He is well-versed in all stages of district court litigation, including pre-filing investigations, pre-trial conferences, trials, hearings, motion practice, discovery, and appellate proceedings.
David advises the law firm community and clients on topics such as data management and preservation, e-discovery best practices, and emerging issues and trends. He helps develop internal course materials and conducts ongoing training sessions regarding substantive and strategic areas of discovery for litigation/controversy matters. David has significant experience in all aspects of discovery, including responding to discovery requests, drafting pre-trial orders, briefing motions, witness preparation, and deposing fact witnesses.
David’s commitment to the firm’s pro bono work extends to the Veteran’s Assistance Program. His work representing clients on a pro bono basis in the U.S. Court of Appeals for Veterans Claims (CAVC) includes successfully handling a veteran’s disability rating appeal, which resulted in obtaining a 100 percent disability rating for the veteran.

Represented VIA Technologies and Centaur in ITC investigation against Apple asserting infringement of microprocessor architectures and the instruction sets associated with microprocessors. Served in a leading role on the team representing Via and Centaur, taking and defending witness testimony at deposition. The case settled favorably prior to an initial determination.

Eli Lilly & Co. v. Wockhardt Ltd.
Represented Eli Lilly in Hatch-Waxman patent infringement litigations against several ANDA filers seeking FDA approval to market generic versions of Eli Lilly's Cymbalta®. The S.D. Indiana entered judgment before trial in favor of Eli Lilly and against all the ANDA filers on all issues, resulting in orders and judgment maintaining Cymbalta's® market exclusivity through the end of its patent life.
