As a former attorney with the U.S. Patent and Trademark Office (USPTO), Dan leverages his insider insights to provide clients with strategic advantages in building and protecting robust, enforceable brands across diverse industries. His comprehensive experience encompasses trademark selection, clearance, prosecution, portfolio management, as well as litigating oppositions, cancellations, and ex parte appeals before the Trademark Trial and Appeal Board (TTAB) of the USPTO. Dan has a particular interest in nontraditional trademarks, which often present novel legal and strategic challenges. He applies his extensive experience to help clients navigate the complexities of securing rights in these distinctive forms of trademark protection.
Prior to joining Finnegan, Dan served as an associate solicitor with the Office of General Counsel at the USPTO. He defended agency decisions in district court and before the U.S. Court of Appeals for the Federal Circuit as well as advised USPTO leadership and other federal agencies on trademark regulations, practices, and policy.
Dan previously served as a trademark examining attorney with the USPTO, and in this role prosecuted thousands of trademark applications, including applications for trade dress, certification marks, scent marks, and other non-traditional trademarks. His significant experience at the TTAB includes drafting more than a dozen appeal briefs and successfully representing the USPTO at several oral arguments on issues of descriptiveness, genericness, and product design.
While in service at the USPTO, Dan received an award from the American Intellectual Property Law Association (AIPLA) for his contributions to the integrity of intellectual property law. The award is presented to examining attorneys who exhibit sustained excellence in trademark examination quality and production.
