Annabeth Foley leverages her foundation in biomedical engineering and prior experience as a patent examiner at the U.S. Patent and Trademark Office (USPTO) to help clients navigate the intersection of medical device technologies and intellectual property (IP) matters. Her practice spans post-grant proceedings, litigation support, and patent prosecution across a range of technologies.
Annabeth serves clients in diverse industries, with a particular focus on medical devices and biotechnologies. She supports litigation before the Patent Trial and Appeal Board (PTAB) and U.S. district courts and prepares and prosecutes patent applications before the USPTO.
Annabeth’s legal experience extends to serving as a judicial intern to the Honorable Jimmie V. Reyna at the U.S. Court of Appeals for the Federal Circuit (CAFC) and interning with the Office of General Counsel at the U.S. International Trade Commission (ITC). These roles provided her with valuable insight into appellate litigation and Section 337 investigations. Annabeth’s work involved analyzing administrative law judge (ALJ) determinations, researching issues regarding the Bayh-Dole Act and experimental use defense, and evaluating a range of trademark and patent matters.
Prior to law school, Annabeth served as a USPTO patent examiner. She reviewed more than 180 patent applications related to electrosurgical devices and thermal therapies (Art Unit 3794). This specialized knowledge informs her current work drafting patent applications, responding to office actions, and conducting prior art searches.
