Recent decisions from the Federal Circuit have impacted the scope of method claims and means-plus-function claims covering electrical and mechanical innovations. For example, in NTP v. RIM, the Federal Circuit treated method claims differently from system claims in analyzing the extraterritorial scope of U.S. patents. Method claims were also at the root of the Federal Circuit’s new standard for joint infringement addressed in the BMC and Muniauction decisions. Method claims have differing treatment under the U.S. marking statute as compared to system and device claims. This webinar will discuss how the current status of U.S. patent law on method claims has influenced cutting-edge claim drafting strategies for the electrical and mechanical innovations. It will also cover means-plus-function claims and provide tips on when and how to best use these claims in your practice.
