Trade secret cases are becoming more widespread in the United States, especially cases involving established companies against newcomers. These lawsuits are difficult to win for defendants, and the consequences of losing them have become even more serious with the increasing prosecution of criminal cases involving trade secret theft. Since many Taiwanese companies are market leaders, they need to be concerned with both protecting their secrets as well as avoiding potential liability.
This program addresses practical ways to strengthen trade secret programs and to avoid lawsuits alleging trade secret theft. If the lawsuit cannot be avoided, we discuss ways to increase the chances of prevailing. Cases will be discussed to understand what worked and did not work for both parties.
