  1. Is Your Approach to Intellectual Property Due Diligence Outdated? New Strategies for IP Due Diligence with Special Consideration for Standards Essential Patents and Artificial Intelligence IP
    The technology sector ecosystem of today is marked by frequent mergers, acquisitions, technology onboarding transactions, open innovation, and intellectual property litigation requiring the early engagement of IP specialists through carefully-orchestrated business processes. And as business models and technology evolve, so must the techniques applied during diligence investigations. This presentation covers: 

    • Best practices for due diligence associated with intellectual property matters, including techniques for risk assessment and risk mitigation in today’s fast-changing business environment
    • Emerging due diligence issues using two evolving areas of law: standards essential patents and artificial intelligence IP

  2. Developments in Post-Grant AIA Proceedings: Updates and Strategic Considerations for PTAB Trials in Light of an Evolving Legal Landscape
    Post-grant review petitions are now a consideration in virtually all patent disputes, whether as an alternative to district court for determining patent validity or as leverage in settlement or licensing negotiations. But because these IPR, CBM, and PGR proceedings are still new, the governing laws and regulations are constantly changing and laden with traps for the unwary. This presentation addresses several recent and possible future developments, including related strategic considerations. Topics include: 

    • Oil States Energy Services, LLC v. Greene’s Energy Group, LLC (S. Ct.) regarding the constitutionality of post-grant proceedings
    • In re Aqua Products, Inc. (Fed. Cir.) regarding claim amendments in post-grant proceedings
    • General Plastic Industrial Co. v. Canon Kabushiki Kaisha(PTAB) regarding serial AIA petitions

  3. Where Can You Be Sued in the U.S. Today?
    A number of Supreme Court and Federal Circuit decisions over the past few years have shifted the way courts in the United States approach personal jurisdiction and venue, generally making it more difficult for plaintiffs to forum shop when initiating an action, and making it more difficult to bring suit against a defendant residing outside of the United States. In this presentation, we will discuss: 

    • Where the law currently stands on personal jurisdiction and venue by reviewing key recent cases on both issues, such as the Supreme Court decisions this year in BNSF Railway Co. v. Tyrrell, Bristol-Myers Squibb v. Superior Court, and TC Heartland v. Kraft Food Group Brands, as well as the Federal Circuit’s decisions in Xilinx, Inc. v. Papst Licensing GmbH & Co. KG and In re Cray Inc.
    • Strategies and considerations in light of these cases, particularly with respect to Taiwan-based companies
