Emily Gabranski focuses on complex patent and trade secret litigation, primarily in the biotechnology, biologics, and pharmaceutical fields. She represents clients in U.S. district courts, where she has served as trial counsel in bench trials for Hatch-Waxman cases and in jury trials for brand-on-brand litigation. 

Emily has significant experience in all phases of pre-litigation and litigation, as well as counseling and diligence matters, pertaining to a wide range of technologies, including small molecule pharmaceuticals, therapeutic antibodies, inorganic chemistry, semiconductors, and gene therapies. She was named on the Best Lawyers “Ones to Watch” list in 2023-2025.

 

Prior to joining Finnegan, Emily conducted research in cellular and molecular neurobiology. Her research focused on transmitter modulation of neuronal network interactions. She coauthored two peer-reviewed publications in scientific journals and presented her research at a Society for Neuroscience annual meeting.

 

Emily is devoted to pro bono work and has successfully represented clients in custody disputes, post-conviction relief under the Incarceration Reduction Amendment Act (IRAA), and in asylum proceedings. She has been recognized on the Capital Pro Bono Honor Roll.

Experience

Genzyme Corporation et al. v. Novartis Gene Therapies, Inc. et al.

Represented Novartis against Genzyme related to recombinant adeno-associated virus vector technology used in Novartis’ blockbuster, breakthrough gene therapy Zolgensma®. The case settled after four patents were invalidated during claim construction, five patents found not literally infringed, and institution of multiple inter partes reviews (IPRs).

American Regent, Inc. v. Pharmacosmos Therapeutics Inc. et al.

Counsel for American Regent in litigation in the District of New Jersey against Pharmacosmos and their branded drug, Monoferric®, related to American Regent patents covering the use of iron carbohydrate complexes for the treatment of iron deficiency diseases. The case resulted in a favorable settlement for our client.

Duchesnay, Inc. v. Actavis Laboratories Inc. and Mylan Pharmaceuticals, Inc.

Represented Duchesnay in Hatch-Waxman litigation, defending against generic attack on Duchesnay's Diclegis® product.

CMC Materials, LLC v. Dupont de Nemours, Inc. et al.

Represented DuPont in patent and antitrust litigation in the District of Delaware against a direct competitor relating to chemical-mechanical polishing compositions.

1:20-cv-00738, D. Del., Judge Hall

Vifor (International) AG and American Regent, Inc. v. Mylan Labs. Ltd. et al.

Represented Vifor and American Regent in two Hatch-Waxman Act cases against Mylan and Sandoz regarding their attempts to obtain FDA approval for their respective ANDAs directed to generic copies of Injectafer®. After a six-day bench trial, the cases resulted in a favorable settlement for our clients with a generic entry date well past the expiration of the composition patents.
