The number of counterfeit products being sold from abroad via the Internet is growing at an alarming rate. Enforcing one’s design rights in the courts against counterfeits in the United States (U.S.) and Europe can be a costly endeavor. But manufacturers of products with innovative designs may find relief by refocusing their enforcement efforts on goods as they cross the border—either the border leaving the country of the manufacturer, such as China, or at the border as they enter the sales market, such as the European Union (EU).
