2012年12月11日,欧盟议会投票通过创建一个统一专利系统(UPS),实现25个欧洲国家的专利统一性。 虽然西班牙和意大利目前暂时决定不加入该系统,但可能会在以后选择加入。该举措旨在通过一个单一的管理程序,降低成本,并提供更有效的专利保护。UPS拥有三大支柱,每一支柱都有单独的立法和程序: 第一支柱创建一个用于建立一个统一保护系统的工具,;第二支柱提供语言机制,发布和管理统一专利;第三支柱专注于建立一个统一专利法院(UPC),在统一专利的侵权和有效性方面具有专属管辖权。
统一专利将与国家专利及古典欧洲专利共存,它们采用相同的法律依据和授权程序。统一专利只在授权后的阶段有所不同,将按统一专利处理,不再需要在各个欧洲国家进行验证(包括翻译)。专利将提供英文版、法语版和德语版,UPS支持者声称这将免除将专利翻译成其它语言的需要,从而使目前的专利费缩减高达80%。在UPS下,欧洲专利局(EPO)在检验和管理统一专利方面将发挥至关重要的作用,正如其在处理欧洲专利时起的作用一样,但主要区别在于专利授权后所享受的法律保护的地域范围。
UPC将由一个初审法院(CFI)、一个上诉法院和一个注册登记处组成。CFI将设中央处、地方处和地区处,其中,中央处分设在巴黎、伦敦和慕尼黑。伦敦分处将负责化学、冶金、制药以及生命科学和人类生活必需品方面的案件。慕尼黑分处将处理机械工程、照明、供暖、武器和爆炸类案件。巴黎的中央处将作为总裁办事处,也会负责执行操作、运输、纺织和造纸、固定建筑物、物理和电力等方面相关的案件。地方处和地区处将处理部分侵权案(如果他们愿意的话,也可以处理反诉撤销立案),如果该侵权案实际发生或拟将发生在本地区,或该侵权案的被告或被告之一是该地区居民或其主要营业处位于本地区的 。另外还将在卢森堡设一个单一的上诉法院。
UPS将在包括英国、法国和德国在内的全部13个欧洲国家认可批准后,即2014年1月1日,生效。
