2013 年 1 月,FTC 公布其拟议的同意令以征询公众意见(参见 http://ftc.gov/opa/2013/01/google.shtm),并在综合考虑所征得意见后做出了修正同意令。FTC 在较小方面通过技术手段修正了先前拟议的同意令。
同意令要求谷歌必须满足特定要求后才能针对负有 FRAND 义务的 SEP 侵权行为申请禁令或排除令。这些特定要求包括为潜在被许可方提供 (1) 一份书面要约,其中包含授予其 SEP 许可所需的所有实质性许可条款,以及 (2) 一份具有约束力的仲裁要约,用于确定任何未商定一致的许可条款。FTC 在其 1 月份发布的公开声明中还表示,该同意令可能为许多行业内涉及 SEP 许可争议的解决提供了一份模板。
