The steep rise in U.S. patent litigation alarms many Chinese companies that are trading in or are thinking about entering the U.S. market. But the tide is turning. Recent developments are making patent infringement cases more favorable for defendants. First, the America Invents Act (AIA) makes post-grant review proceedings available to challenge validity at a fraction of what it would cost to defend a district court infringement action. Second, recent Supreme Court decisions are making it harder to bring a patent infringement case. Third, the Supreme Court has enabled the district courts to permit a successful defendant to more easily recover their attorney’s fees from the plaintiff.
A principal purpose of this seminar is to educate anyone doing business in the U.S. market about these changes in patent infringement litigation. We will discuss ways you can improve your chances of staying out of a dispute and ways to improve your chances of winning if you are in one. This seminar will also serve to educate patent owners, in any technology, to enhance the chances that their patents, if challenged, will survive a post-grant review proceeding.
