2013年7月24日、米連邦取引委員会(FTC)は、米Googleの傘下であるMotorola Mobilityの特許権を巡る訴訟の解決に向け、修正同意審決を承認したと発表しました。FTCは、Google-Motorola Mobilityに対し、公正、合理的、且つ非差別的(FRAND条項の確約)にライセンス供与されるべき標準必須特許が、該特許権のライセンスを希望する者(Willing licensees)により侵害されたとして、法廷および米国際貿易委員会(ITC)で差止および排除命令を請求した同社の行為は、米国連邦取引委員会法第5条(15 U.S.C. § 45)違反にあたるとしました。(参照: http://www.ftc.gov/opa/2013/07/google.shtm)
FTCは今年1月に同意審決案を発表しており、 (参照:http://ftc.gov/opa/2013/01/google.shtm)パブリックコメントを求めていました。その結果を反映した上で、修正審決を承認しました。修正は同意審決に若干の修正を加えたものであるとしています。
同意審決では、Googleに対し、FRANDに係っている標準必須特許の侵害に対する差止及び排除命令を請求する以前に、ある一定の要件に準拠しなければならないことを求めています。その要件とは、Googleが潜在的なライセンシーに対し、(1)標準必須特許のライセンスを供与する際重要となる全てのライセンス条項を書面で提示することや、(2) 合意に達していないライセンス条項を決定するため、拘束力のある仲裁を申し出ることなどです。FTCはまた、今年1月のパブリック・ステートメントで、本審決は、多くの産業における標準必須特許のライセンス紛争解決の雛形になるだろうと述べました。
パブリック・コメントでの意見を受け、FTCは以下のように回答しました:
本件の和解は、今年4月にBosch社が関与した類似する訴訟へのFTCによる和解に倣っています。該訴訟では、FRAND条項が確約された標準必須特許が侵害されたことに対し、Bosch社が該特許の差止を求めていたことが争点となっていました。
