2012年7月26日USPTOはリーヒ・スミス米国発明法(AIA)の先願主義制度における(1)規則改正案及び(2)審査基準案を公開しました。77 Fed. Reg. 43,742 (July 26, 2012); 77 Fed. Reg. 43,759 (July 26, 2012).
USPTOは規則改正案及び審査基準案についてのパブリック・コメント(意見公募)を2012年10月5日まで受け付けています。コメントはこちらのサイトhttp://www.uspto.gov/aia_implementation/comments.jsp 、もしくは郵送にて提出可能です。
従来の米国特許制度である先発明主義はAIAセクション3で先願主義制度に移行されます。先願主義制度は2013年3月16日に施行となります。規則改正案では、USPTOがAIAを施行する手続について定義されることになります。特に、規則改正案では新法(AIAセクション3)の変更により生じる審査問題に一致し、言及をしている、連邦規則集37巻が変更されます。
規則改正案で変更となるのは、概して以下の項目です。
規則改正案には、AIAにより改正された(新)102条及び(新)103条についてのUSPTO側の解釈が詳しく述べられています。とりわけ、審査基準案では、(新)102条a項が定義する特許を認めない先行技術の種類や、(新)102条b項が定義する除外条件に基づき排除される先行技術の種類について説明されています。
USPTOは、2012年9月に先願主義の規則改正案及び審査基準案について、バージニア州アレクサンドリア市、コロラド州デンバー市、ミシガン州デトロイト市、テキサス州ヒューストン市、カリフォルニア州ロサンゼルス市、ミネソタ州ミネアポリス市、そしてニューヨーク州ニューヨーク市の全国各地で協議するものと思われます。各地の詳細情報についてはこちらをご参照ください。http://www.uspto.gov/aia_implementation/roadshow.jsp
