U.S. patent law has recently undergone dramatic changes. Chinese companies doing business in the United States should understand these changes and take advantage of them. For example, the U.S. Supreme Court has made it easier to show that weak cases are exceptional, which may entitle the companies to recover their attorneys’ fees. Companies facing infringement lawsuits from non-practicing entities (NPEs) used to be in a very bad bargaining position. The best they could hope for was a victory that may come at great expense. Now they have a better chance of getting some or all of their expenses back.
The growing popularity of challenging patent validity in the U.S. Patent Office is also good news, especially in terms of addressing threats from competitors. Companies can defend themselves without undergoing the expense of full lawsuits.
The Supreme Court also made it easier to find certain patents invalid for indefiniteness and patent ineligible subject matter. Chinese companies can use this knowledge to assist with their strategic planning and license negotiations by giving them realistic appreciation of risks they face with patent infringement. Recent decisions have also explained which sales are not subject to the U.S. patent laws, and can guide Chinese companies in reducing their exposure to patent infringement. Other trends involve developments in the International Trade Commission and laws the U.S. Congress is considering for NPEs.
