The U.S. International Trade Commission (ITC) has become an increasingly popular forum for bringing patent infringement actions against importers of infringing products, due in part to the ITC’s expedited scheduling. Litigating in the ITC, however, presents a unique set of challenges and companies must understand how to navigate the key substantive and procedural requirements imposed by Section 337 of the Tariff Act of 1930, as amended, and in consideration of recent decisions of the ITC and the Federal Circuit.
