Finnegan client Under Armour prevailed in its lawsuit against Armorina, a women’s athleisure apparel and accessories company. A Maryland federal jury found that Armorina was liable for infringing and diluting Under Armour’s trademarks by using similar marks in their apparel. Finnegan partner Douglas Rettew expressed the importance of the case to Law360.
“The potential damages in the case were very low, because the company dropped its cybersquatting claim before trial and Under Armour acted quickly in bringing the case against Armorina, so Armorina's infringing product sales were low. Therefore, during closing arguments, Under Armour only requested that jurors award $1 in damages,” he said.
"This decision was made to emphasize that Under Armour was not trying to put the defendant out of business, but just to protect its trademark rights and guard the public from deception.”
