Finnegan is a go-to Firm for Patent Trial and Appeal Board (PTAB) proceedings, according to Law360. With 290 PTAB trials, Finnegan secured the number two spot for the most active firms at the PTAB from 2021 to 2023 according a report by Lex Machina.
While Finnegan’s held a healthy number over the last three years, according to Law360, almost all firms saw dips of one kind or another in 2023. Specifically, inter partes review petitions dropped from 1,323 in 2022 to 1,157 in 2023 according to the Lex Machina report. A reasonable explanation for the dip stems from fewer patent suits being filed in 2023.
Finnegan partner Joshua Goldberg acknowledged that he was seeing something of a decline in patent board filings industry-wide. He pointed out, "I wouldn't say that we decreased in terms of the volume that we're doing."
"Just because the public number looks lower doesn't mean the amount of work that we were doing is lower," Josh said. "We, in particular last year, had a lot of petitions that were drafted and then ultimately didn't need to be filed because of a settlement or some other reason."
