The U.S. Supreme Court has declined to take up Innovative Therapies Inc.'s challenge to the dismissal of its preemptive suit seeking to invalidate five Kinetic Concepts Inc. patents for vacuum-assisted wound therapy technology. The high court denied Innovative Therapies' petition for writ of certiorari on Monday, letting stand the U.S. Court of Appeals for the Federal Circuit's determination that a lower court correctly nixed the declaratory judgment suit due to the plaintiff's failure to establish jurisdiction. Kinetic Concepts is represented by Finnegan.
