The Trademark Modernization Act was passed on December 27, 2020, restoring the presumption of irreparable harm in trademark cases, thus allowing brands to obtain injunctive relief. The bill also allows trademark owners to fight fraudulent marks and makes it easier for parties to cancel marks that are no longer in use. Managing Intellectual Property interviewed Finnegan partner Brett Heavner for his thoughts on the legislation.
Brett said, “This bill is really a huge sigh of relief for trademark owners. Now we’re going back to the way it should be.”
