On December 15, 2015, the Patent Trial and Appeal Board (PTAB) granted a request for inter partes review (IPR) by Finnegan client Robert Bosch LLC. The panel agreed with Bosch to institute an IPR of Orbital Australia's fuel injection technology patent. Orbital claims that its patent is being infringed, specifically a "sharp edge" component that Orbital claims is particular to the patent. However, the panel disagrees, stating that the definition of "sharp edge" does not provide reasonable clarity, deliberateness, and precision to construe the term away from its ordinary meaning. The panel also found "reasonable likelihood" that Bosch would be successful in arguing obviousness. The panel is confident that Bosch will prevail at trial on all challenges to the patent.
