After ten years of the America Invents Act (AIA) being in effect, the world of patent law has been forever changed. Law360 interviewed Finnegan partner Josh Goldberg to reflect on how the creation of the Patent Trial and Appeal Board (PTAB) caused a shift in the “balance of power” in patent cases.
Josh said, “At the beginning, [the law] was very much tilting the overall landscape in favor of defendants, but over the years we've seen it start to swing back to no longer favor defendants with the intensity that it did at the beginning."
