Paul W. Browning Ph.D.


Paul Browning focuses on patent litigation and appeals, primarily in the chemical and pharmaceutical areas. He has led teams as first chair at trial, at Markman proceedings, and on appeal. His broad litigation experience includes taking and cross examining witnesses at trial, briefing and arguing dispositive motions, drafting appellate briefs, and arguing cases on appeal. Dr. Browning has also managed day-to-day litigation activities in actions involving multiple parties. He has tried cases before judges in various U.S. district courts, and has also handled arbitrations and mediations.

In addition to his litigation practice, Dr. Browning advises clients on a variety of patent matters, including coordination of prosecution and U.S. and foreign litigation strategy.

Dr. Browning devotes a portion of his practice to pro bono matters, and currently serves as chair of the firm's Pro Bono Committee. He represents military personnel seeking enhanced compensation for injuries received while serving in the military, including injuries received in combat. He also represents veterans in cases before the U.S. Court of Appeals for Veterans Claims and the U.S. Court of Appeals for the Federal Circuit.


  • Represented Ferring Pharmaceuticals, Inc. in consolidated Hatch-Waxman litigations, serving as lead counsel at trial, which resulted in a decision from the bench in Ferring's favor.
  • Represented Otsuka Pharmaceuticals, Inc. in multiple consolidated patent infringement actions concerning Otsuka's blockbuster product Abilify®, managing the day-to-day litigation activities throughout discovery and pretrial preparations and taking and cross examining witnesses at trial.
  • Represented Elan Corporation PLC in patent and antitrust litigation in multiple district court and appellate proceedings in S. D. Florida, the U.S. Court of Appeals for the Eleventh Circuit, and the Federal Circuit. Ultimately resulted in a finding in Elan's favor on the issue of willful infringement and an award of attorneys fees to Elan.
  • Represented sanofi-aventis in arbitration proceedings relating to factor VIII supplements for hemophiliacs, presenting direct examination of key fact witness.
  • Serves as an instructor for the Patent Resources Group chemical patent practice course.
  • Law clerk to the Honorable Glenn L. Archer, Jr., of the U.S. Court of Appeals for the Federal Circuit, 2000-2001.
  • Designed laser systems and conducted spectroscopy of small molecules while earning Masters and Ph.D. degrees at the University of Chicago.
