The American Bar Association Section of Administrative Law and Regulatory Practice and Finnegan will host a panel discussion exploring the impact of the recent decision by the United States Court of Appeals for the Federal Circuit in Cushman v. Shinseki. In Cushman, the Federal Circuit became the first court to hold that persons who are mere claimants for government benefits are entitled to constitutional due process protections. The panel will discuss the Cushman decision; a subsequent Federal Circuit decision in Edwards v. Shinseki; what due process protections the VA may be required to provide; and the potential implications for other government agencies and claimants.
