In response to groundbreaking Supreme Court decisions, the Federal Circuit has recently issued several decisions on patent eligibility under 35 U.S.C. § 101 and validity under § 112 that try to apply the changed law. This seminar will make sense of those decisions, and address some perceived inconsistencies in that court’s claim-construction decisions. There will also be a discussion of the Federal Trade Commission’s recent report on Patent Assertion Entities, and some thoughts of the effect of that report.
