Technical advances in core electronic devices and components make possible the better, smarter, and faster capabilities on demand and driving innovation. Finnegan has a long history of representing leading companies in this highly competitive field, including semiconductor manufacturers and device and component innovators.

Licensing programs and patent pools have become an increasingly crucial component of our clients’ business strategies. Successful companies are taking advantage of these programs to generate revenue, build brand equity and shareholder value, and gain competitive advantages. From Fortune 500 companies to small entrepreneurs, we have helped clients set up and run licensing programs that have generated significant revenue streams, and we have worked with clients to pool patents and deal with standards issues.

Understanding the law, science, and technology

To work effectively with companies in this fast-paced technical landscape, it is not enough for a law firm to simply know the law. Finnegan’s more than 100 professionals with degrees in electrical and computer technology-related fields includes more than a dozen with Ph.D.’s in disciplines such as electrical engineering, materials science and engineering, and physics. Our experience extends from single devices, such as LEDs and analog circuits, to complex VLSI and ULSI circuitry. We help with:

  • Developing a strong and comprehensive patent portfolio by obtaining patents in both the United States and abroad
  • Analyzing the competitive landscape in specific markets and advising clients in areas in which they have freedom to develop new products without running afoul of others’ intellectual property
  • Negotiating license agreements that provide the freedom to get products to market and keep them on the market
  • Negotiating license disputes
  • Monetizing patent portfolios to generate additional revenue streams
  • Performing sophisticated damages analyses both within and outside of the context of FRAND licensing requirements
  • Asserting patents in litigation to protect our clients’ intellectual property
  • Defending clients from claims of infringement before U.S. district courts, the International Trade Commission (ITC), and the Court of Appeals for the Federal Circuit
  • Challenging and defending patents in administrative proceedings at the U.S. Patent and Trademark Office (USPTO), including ex parte re-examinations, as well as inter partes review (IPR) and post grant review (PGR) proceedings before the Patent Trial and Appeal Board (PTAB)
  • Obtaining protection under the Semiconductor Chip Protection Act and litigating under that Act
  • Advising on trade secret protection and litigating misappropriation cases
  • Providing trademark, copyright, and advertising services
