The Federal Circuit upheld a Kansas jury’s $140 million verdict that Time Warner Cable’s internet voice service infringed five Voice over Internet Protocol (VoIP) patents owned by Finnegan client Sprint. Joining the Sprint trial team led by Shook Hardy & Bacon, Finnegan’s appellate team worked with them to preserve the jury verdict. The court of appeals rejected Time Warner’s arguments that the district court (Judge John W. Lungstrum) improperly admitted a prior verdict against another company, which involved some of the same patents and the same technology. The court then upheld the damages award as a reasonable royalty, rejecting the argument that Sprint’s expert did not properly apportion the damages amount to the incremental value added by the patented invention. And in a 2-1 split, the court upheld the jury’s finding that the patents were not invalid for failure to satisfy the written description requirement, with one Federal Circuit judge dissenting. The full court denied Time Warner’s petition for rehearing en banc.
