Finnegan client Playtika achieved a clean sweep victory, invalidating all five of its adversary's gaming patents in district court litigation. When NexRF sued Playtika for patent infringement, Playtika brought in Finnegan and challenged the validity of the patents in a preliminary motion to dismiss in the U.S. District Court for the District of Nevada. Playtika also challenged a group of NexRF’s patents in inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB).
In Nevada, Playtika first won a motion staying all critical deadlines pending the court’s ruling on the motion to dismiss. The court ruled that all five of NexRF’s patents are invalid as patent ineligible under 35 U.S.C. §101. At the same time, the judge dismissed the entire suit with prejudice, handing Playtika a complete victory in district court. Finnegan is continuing our representation of Playtika in the appeal filed by NexRF.
