Reginald joined Finnegan after serving for over a decade with the ITC's Office of Unfair Import Investigations, where he litigated cases involving both utility and design patents, trade secrets, trademarks, and antitrust. He has been involved in numerous ITC investigations, including several trials, often serving as first-chair trial counsel. He was the lead ITC trial attorney in the high-profile investigation, Apple v. Samsung et al., a six-patent case involving software and hardware related to the touch-screen swipe technology of Apple's iPhone. He was also the lead ITC trial attorney in the high-profile investigation, Navico v. Garmin, a patent case involving marine sonar equipment. Additionally, Reginald served a lengthy detail as the ITC chairman's Section 337 litigation counsel, counseling the chairman on Section 337 litigation and working with the ITC's general counsel's office in reviewing the Judges' decisions on violation. He has also argued at the appellate level before a full panel of commissioners, presenting oral argument in the highly publicized case, U.S. Steel, Inc. v. Baosteel. He is only one of a handful of lawyers in the country who has argued before a full panel of ITC commissioners in a Section 337 proceeding.
Reginald's litigation experience runs the full gamut, including pre-filing due diligence, presenting oral argument at Markman hearings, presenting opening statements at trial, examining both fact and expert witnesses at trial, deposing fact and expert witnesses, developing invalidity and infringement contentions, managing fact discovery, drafting Markman and discovery briefs, drafting pre- and post-trial briefs, and preparing expert witnesses for trial.
Reginald's technical proficiency includes software algorithms, cellular telephony communication standards (e.g., 3G, LTE), semiconductor chip architecture, electronic speakers, radar and sonar technology, electronic consumer devices such as laptop computers and cellular telephones, computer networking, computer power systems and architecture, and computerized processes for manufacturing steel.
Before serving as litigation counsel for the ITC, Reginald worked in the private sector for a large, multinational Am Law 100 law firm in New York, focusing on intellectual property litigation. Prior to becoming an attorney, Reginald worked for two large DOD contractors as a systems engineer.
