Jason Fountain focuses on patent prosecution, post-grant proceedings, patent and trademark litigation, and counseling across a wide range of technologies, including automotive components, telecommunications, medical devices, and consumer products. Jason draws on a rare combination of experience through managing design and manufacturing engineering, examining patents at the U.S. Patent and Trademark Office (USPTO) for nearly a decade, and litigating across multiple forums.
Jason has litigated patent disputes before district courts, the Patent Trial and Appeal Board (PTAB) of the USPTO, and the International Trade Commission (ITC). He has been involved in drafting complaints and answers; preparing inter partes review (IPR) and ex parte reexamination (EPR) papers; preparing infringement and invalidity contentions; claim construction briefing; working with technical experts; managing discovery and large-scale document productions; and briefing pretrial motions. Jason also counsels clients on patent enforcement strategies and litigation risk assessment.
Jason’s trademark experience includes analyzing products for potential infringement risk and advising clients on enforcement and compliance strategies. For trademark matters, he has drafted cease and desist letters, litigation and prosecution motions, acceptable use policies, and settlement agreements.
Prior to his legal career, Jason served as a patent examiner at the USPTO, where he examined and prosecuted more than 400 patent applications in the mechanical arts. His examination work focused on impellers, including propellers, turbines, as well as pumps, and their associated control systems and impeller control logic. Jason also worked as a plant tire designer at a multinational tire manufacturing corporation, giving him practical insight into complex mechanical systems and industrial processes.
Jason’s commitment to pro bono service includes representing a pro se inventor before the PTAB and a U.S. military veteran in a discharge upgrade petition.
