Associate
James Donegan is a registered patent attorney focusing on intellectual property (IP) litigation involving complex technologies across diverse industries, including semiconductors, medical imaging, mobile navigation, telecommunications, video compression, and access control systems. His experience involves global patent litigation disputes, including standard‑essential patent (SEP) matters. Drawing on a robust technical foundation in electrical engineering and experience as the IP manager for a technology company, James integrates business acumen, legal strategy, and technical insight to skillfully resolve the most pressing demands of high-stakes patent litigation.
James represents clients in IP litigation before federal courts, the U.S. International Trade Commission (ITC), the Court of Appeals for the Federal Circuit (CAFC), and the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO). He plays critical roles in high-value, multi-jurisdictional, and transnational IP disputes, including managing discovery and conceiving and implementing intricate non-infringement and invalidity defenses. James drafts complaints, answers, counterclaims, invalidity contentions (including associated cover pleadings), motions to dismiss, claim construction arguments, domestic and international discovery requests (and objections and responses to the same) and significant portions of expert reports on numerous patent law issues. He has presented an oral argument before the PTAB and has extensive experience related to emergency motions before the CAFC, depositions, trial, and post-trial advocacy.
James was previously the IP manager for a technology startup. He directed patent litigation counsel in district courts and before the PTAB, managing both offensive and defensive inter partes review (IPR) proceedings, as well as patent and trademark prosecution strategy; managed invention review processes; and served as the corporate deponent in patent infringement litigations.
