Howard Herr, Ph.D., focuses on intellectual property (IP) disputes involving complex technologies, including advanced semiconductor devices, cloud computing, mobile devices, and medical devices, brought before the U.S. International Trade Commission (ITC), district courts, and the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO). Howard is an experienced IP litigator with a doctorate in electrical engineering and fluency in Mandarin, and he has twice served as embedded litigation counsel at one of the largest semiconductor manufacturers in the world.

Howard has extensive experience coordinating multi forum patent litigation strategies and building robust technical records. He regularly works at the intersection of engineering and law, collaborating closely with in house engineers, expert witnesses, and technical teams to shape winning invalidity and non infringement positions. 

 

Howard’s service as full-time embedded litigation counsel included an extended on-site engagement for a major ITC investigation. Working in person with the client, he developed key non-infringement and invalidity defenses and successfully defeated critical discovery requests. His on-site role was extended multiple times at the client’s request, reflecting his effectiveness in high-pressure, mission-critical litigation. Howard also coordinated international IP defense and enforcement campaigns spanning multiple jurisdictions, including ITC proceedings, U.S. district court litigation, and actions in Europe and Asia. He has evaluated licensing agreements affecting patent portfolios, freedom-to-operate (FTO) analyses, and global supply-chain risk.

 

Howard has been involved in approximately 100 post-grant proceedings and several ITC and district court matters involving subject matter spanning cloud computing, video processing, mobile devices, gesture recognition, Voice over Internet Protocol (VoIP), medical devices, and semiconductor devices.

 

Before his legal career, Howard worked as a semiconductor process integration engineer at an American multinational semiconductor company, leading research and development initiatives in silicon-germanium (SiGe) transistor integration for high-performance bipolar complementary metal-oxide-semiconductor (BiCMOS) applications and managing fabrication processes in high-volume manufacturing environments. Howard’s doctoral studies focused on advanced transistor structures, including nanowires and gate-all-around (GAA) transistors.
