Douglas Cheek focuses on complex patent litigation and trade secret matters in a wide array of technology areas. He has litigated before federal district courts, state courts, the Patent Trial and Appeal Board (PTAB) of the U.S. Patent and Trademark Office (USPTO), and the U.S. Court of Appeals for the Federal Circuit. Douglas has experience in Abbreviated New Drug Application (ANDA) and 505(b)(2) Application litigations arising under the Hatch-Waxman Act.
Douglas's range of patent litigation experience includes pre-litigation analysis, fact and expert discovery, claim construction, motions practice, pre-trial strategies, trials before federal district courts, post-trial briefing, and appeals before the Federal Circuit. He is also versed in inter partes review (IPR) proceedings before the PTAB and trade secret proceedings before federal and state courts.
Before attending law school, Douglas conducted graduate research synthesizing and testing the properties of a pH-sensitive, fluorescent molecule. Using nuclear magnetic resonance spectroscopy and mass spectrometry, he developed an efficient synthetic pathway to the bicyclic, organic molecule and several of its derivatives.
Douglas is dedicated to pro bono practice. He has represented multiple clients before the Court of Appeals for Veterans Claims, writing memoranda and briefs to attain greater coverage for veterans suffering from service-connected disabilities. Douglas also assisted in the successful asylum petition of a Rwandan political activist.
