Alexander P. Wharton

Alex represents clients in patent litigation involving branded pharmaceutical products. His experience spans all phases of litigation, including motion practice; fact and expert discovery; deposition preparation and support; post-trial proceedings; and appellate matters before the U.S. Court of Appeals for the Federal Circuit (CAFC). 

In addition to his life sciences litigation practice, Alex has handled high-technology patent disputes, trademark litigation before federal courts and the Trademark Trial and Appeal Board (TTAB) of the U.S. Patent and Trademark Office (USPTO), trade secret matters, and business litigation in Delaware state courts. He has also advised a major pharmaceutical company on IP due diligence related to strategic investments and emerging technologies. 

Alex's technical foundation is grounded in the biological sciences. Before entering law school, he conducted oncology research at a major pharmaceutical corporation, where he worked on target-validation projects utilizing CRISPR technologies and genetic vectors in breast and colon cancer research. Alex’s scientific training enables him to effectively analyze and communicate complex technologies in life sciences and biotechnology disputes. His personal background enhances his ability to cater his litigation and strategic advice to both multinational pharmaceutical corporations, as well as smaller, foreign pharmaceutical companies, such are those that are less familiar with the intricacies of U.S. patent law and litigation practices.

Alex is a recognized thought leader on IP issues. He has authored client alerts and publications addressing significant developments in patent law and judicial decisions. He was named in Best Lawyers: Ones to Watch for consecutive years.
